getting a speeding fine while license is suspended

hi all

my brother lost his license last november for

1) 25km/h over limit
2) 61km/h over limit
3)?

and he is a red P plater...

so all up he has lost it for 9 months.

he is going to court because he hasnt paid for his #2.
How much does court cost?

fine number #4 has arrived in the mail which is from a camera at 15km/h over
in december -- while his license is suspended... what will happen to this?
goto court again? bigger fine?

Sounds like a good option to me, odds are what will happen tho is he will
get the drivers offenders program and a slap on the wrists

No he's not. He's "licence cancelled".

Is he challenging it or has he simply not paid it?

Time to get a lawyer.

Seriously, get a lawyer.

Obviously if he is found to have been driving the car in the december
photograph, he will be charged with driving whilst disqualified, which
is ugly.

A lawyer (and no one less than a lawyer) can tell him if it is possible
to avoid this.

For example, it is concievable that:

A) If he pays the december fine, he has declared himself to have been
the driver of the car, resulting in a charge of driving whilst
disqualified.

but

B) If he says he doesn't know who was driving the car at the time, they
"deem" him to have been driving it, so he wears the fine and the points,
but most importantly *has not been proven to have been physically
driving the car* and therefore does not get charged with driving whilst
disqualified.

I AM NOT A LAWYER. I do not know if this is what happens.

The likely consequences of getting this wrong and being charged with
driving whilst disqualified are ugly and expensive.

TELL HIM TO FIND A LAWYER.

And tell him to ride his bicycle to the lawyer's office.

A likely outcome is that he cons a soft hearted family member into claiming
they were driving his car at the time.  If he doesn't there is a good chance
that he will go to jail for a few months and lose his licence for a few
years.

I don't have any statistics on the average penalty, and I don't even know
what state you are in, but in NSW, driving while disqualified has a maximum
penalty of 18 months in jail and a fine of $3300, as well as additional
driving bans.

Sounds like the world will be a safer place with him off the road.

Well they tend to impose  community service or weekend detention when people
dont pay fines
Little pointing fining them more when they dont pay fines...

Well he can nominate someone else as the driver of his vehicle.

As they can't be sure that it was him driving, they cant charge him with
driving while disqualified.
So it will just add to his suspension...

Although if he admits to driving in the court room, then prosecuters might
ask for  driving while disqualified as well ?

Ask your Mum or Dad to get him a Lawyer, he WILL need one as he is in big
trouble.

Also find his car keys and throw them away.

Basically, he's stuffed, big time!

The fact that the first two infringements were for significant infractions,
then when disqualified he not only continued to drive, but to speed, no
magistrate will do anything but throw the book at him. And nor should
they... your brother is a dick. What sort of family lets him drive whilst
disqualified??? He's a dick, sounds to me like the rest of you are
irresponsible.

sadly that is untrue , the 8 tends to install to far back and destroys
the natural handling of the Jag , mush better to add a blower or turbo
and enjoy the ride

Sorry the magna cannot take a SBC and make it a decent car.

Yeah, it needs a Toyota Crown chassis, Jag suspension front and rear
_plus_ the SBC...  Then, in spite of looking like a Magna, the NSW RTA
will call it a 1967 Toyota Crown (chassis determines vehicle).

Part of it have to be modified, but not as excessively as one might
expect.  You also need to realise that the chassis will have less
ground clearance than a stock magna.  The aim is to achieve the legal
100mm ground clearance while keeping the Magna at about stock ride
height.

I'm looking seriously at fitting airbag suspension to it.  The XJ
front end looks ideal for airbags - the bolt-in bottom plate under
the coil spring makes things fairly easy.  I've seen photos on the
net of a Jag IRS with a single airbag per side - I don't like that,
and would prefer to run 2 airbag-over-shocks per side to retain the
load distribution within the suspension components.

The airbags will allow me to have about 110mm ground clearance no
matter how much load there is in the vehicle.

Anybody know if any XJ series jags have been converted to airbag?

Its been made very difficulty here in QLD re bags , none std cant be
fitted into machines which didn't have the option so I suspect it might
happen your way , do you think bags are better ?.

I know exactly why airbags have been banned.  I've seen bodgy airbag
systems, complete with manual controls that allow the ride height to
be set to anywhere you want.

I've only certified one airbag car, and that was with airbag struts
in the front and cylinders in the rear that directly replaced stock
springs and retained dampers in the original locations.  The car also
had ride-height sensors that forced it up to legal height when the
ignition was switched on.  Obviously, the latter would only take a
small change or two in the wiring to disable, and that is where the
problem exists.

I'd be proposing to QLD (or the RTA here if they tried the same
stunt) that airbags be permitted provided that their height is
controlled by a ride-height control valve as per all truck airbag
systems.  The ride-height control valve _always_ controls the air
bag height, except for "traction dump" valves used with lazy axles,
where the lazy axle's airbags can be dumped to increase load on the
drive axle.  Traction dumps are operated from a momentary action
switch in the cabin, and releasing the button immediately returns
the airbags to normal loadshare mode.  The compressor should
probably be required to operate automatically whenever the engine
is running...

I've also seen a Mercedes Benz truck with ride-height control valves
with 3 positions electrically selectable from the cabin - that's
what I'd like to use.

The most impressive airbag installation I've ever seen is in the new
"Varley" fire trucks (made at Tomago), which have 4 airbags, with a
ride-height control valve at each bag.  They are virtually a race
car chassis with a fire truck on top - nothing like a conventional
truck chassis!

Athol, the XJ40 series had an airbag rear end, the current XJ350 has air
all round.
Yes, the older XJ rear ends that I have, have four springs for balance,
with the shocks inside.  They give a very good ride as is.  As long as
you mount the Jaguar front and rear suspension on with the rubber mounts,
you will have a smooth quiet ride :-)

My concern is that I have to set up the chassis height at about 110mm,
and the rule says "at any condition of loading".  With air, I can set it
up at 110 and know that it will always be there.  With steel springs, I
have to set up at about 130 or 140 to get 110 fully laden...  It is a
wagon, after all.

Athol, that is not a worry :-)
The spring/shocky combo will adjust the height.
i.e. a 420G has higher spring/skock than an XJ6 and has the same rear
end.
I'm sur you could even make an adjusting device between the lower bolt
mount and the s/shock.

Incorrect on the smoke part and I have no interest in 'doing up' a daily
driver.  It's just a Magna that I use to get from here to there, not a poser
machine that I want everyone to notice......and I paid a rock bottom price
for it at the time.  I don't choose cars according to what others may think,
that's why Commodores were 5 to 7 grand more expensive at the time for
basically the same thing.  I'd rather spend that money on booze and women.

Nah, I've taken mine to 180.  Still had plenty left in it too.  That's way
more than enough for a daily driver.  But if you wanna talk about the Torana

we are not irresponsible. we did all we could to stop him from driving - but
in the end it was his choice to keep driving.

Take his keys, if that fails, report him to the police.

From the offences he's committed, and disregard for the punishments handed
out to him, he's probably an unsafe or even dangerous driver.

What do you prefer? That he's pissed off at you for a while, or that he's
potentially dead through his own stupidity, or worse, has killed someone
else? It may seem harsh, but he's quite clearly the sort of driver we don't
need on our roads.

He hadn't even paid the $1500 fine before he committed a further offence,
this time with a disqualified license.
The fine didn't register in Mr. Thick's brain so he continued to behave badly.

The NSW police can impound your car for doing a burnout.
Why can't they confiscate the cars of people like Mr. Thick ?

You hear about this sort of twit on the police radio every day.

Driving while unlicensed leads to further suspensions, and further
suspensions and further........ (you get the idea). And fines.

In the end, they don't even bother trying to get their license back. They
just keep on driving.

Heard one this week where the guy was pulled over for something, and
was unlicensed.  He could have gotten his license back a couple of years
ago, but had not bothered because he just thought he would loose it again.

There have been several this week where a car fails to pull over, leading
to a short pursuit, followed by the driver 'decamping'.  Both unlicensed
drivers, driving cars registered to themselves!!!!

One policeman summed it up nicely.  'Let's tow his car back to the station,
and he can come and ask for it back!'

BTW, in Victoria, there seems to be a law about failing to follow directions
given by
a police officer.  This is what they charge you with if you don't stop when
told to pull over.

Drive while license suspended == *VERY* big trouble with *VERY* bad
juju.

He will need some very good character references, and some very good
legal representation.I don't think anyone would expect a magistrate
to give a good behaviour bond with that though.

Somewhere in his travels, around when he lost his license, he
missed out on the "learning" part.

Apart from the bleeding obvious defect in his genetics I suspect the only
option he has is to surrender his permit to the judge. Speak to a lawyer and
read up on the implications of a volutnary surrender. It is a pretty good
way to have the case terminated.
