Rear Brake Lights Always On

I have a 99 323i. The brake lights are always on and the dash display
shows both rear light indications. Is this a problem with the brake
pedal sensor? Also, does any one have advice on removing the panel
around the pedals. The screws are obvious, but there is a small plastic
rivet on the right side that is quite stuborn. Thanks for your help!

That's not a rivet - it's a small trim cover over a philips screw. Pry
the cover off gently and the screw will be revealed.
