South Australia slams hit & run offenders

Hit-run drivers face life in jail

DRIVERS in South Australia who cause death or serious injury by
dangerous driving in hit-run smashes or "aggravated" circumstances face
life imprisonment.

Premier Mike Rann yesterday said the government would change the law to
ensure "drivers get life imprisonment for killing or seriously maiming
another" in "aggravated" circumstances, including the driver fleeing
police, having a blood alcohol reading of 0.15 or more or driving under
the influence of drugs. The maximum penalty for leaving the scene of an
accident would rise from one year to 15 years for a first offence and
life for a subsequent offence - up from 10 years. Mr Rann said that made
the penalty for such an offence equal to that for manslaughter. "When it
comes down to these hit-and-run merchants, it's going to be manslaughter
from now on," he said. For non-aggravated offences, the maximum penalty
would rise to 15 years.

The announcement came after Attorney-General Michael Atkinson revealed
he had asked the Director of Public Prosecutions to appeal against last
week's suspended sentence to a teenaged ward of the state who, in April,
2004, killed Riverland man Johnny Miller while drunk and driving a
stolen car.

No Pokies MP Nick Xenophon and the Opposition called for an independent
inquiry into the death and adequacy of sentence.

Mr Xenophon said the Government "needs to go much further" than
increasing penalties. "If they want to remove any incentive for anyone
to leave the scene of an accident, there needs to be a presumption that
if you leave the scene of an accident, you've been driving dangerously
unless you prove otherwise," he said

Great article, lex baby.  I've been saying the same thing for years
here in america but unfortunately all a highway killer has to do in
criminal coddler america is say "hey dood, it was an accident" and
nothing is done to you.  Just ask First Lady Laura Bush who committed
vehicular manslaughter in front of witnesses and was never charged
with anything!! And the guy she killed was her ex boyfriend!!!

There's one big difference with the laws you're calling for, and South
Australia's new laws.  SA's laws only apply to hit and run offenders.
Automatic life imprisonment only applies if someone kills or maims an
innocent bystander, then runs from the scene *if* they have a high level
BAC, are under the influence of illegal drugs, or are fleeing from police.

If they maim or kill someone whilst committing any of those offences,
but stop at the scene, then they'll still be in a lot of trouble, but
life imprisonment will not apply.

A max of 15 years applies if a person kills or maims another person in
their vehicle when they were adhering to the law, or breaking a more
minor law (running red lights etc), then chooses to run from the scene
rather than stop and render any assistance possible.  On the second
offence, life imprisonment applies.

You, Laura dearest, are calling for ridiculous and unreasonable
punishments for minor offences, including imprisonment for low level
speeding.  Accidents and mistakes happen, we're only human.  However
running from the scene of a traffic accident, is no accident, and is a
sign of a selfish coward who can't live up to the consequences of his or
her own actions.

I'm no criminal coddler. Speeders are killers and maimers and i want
them to get more than a fine though it doesn't have to be prison in all
cases. As for laura bush, i think that anyone who drives recklessly and
consequently kills someone deserves decades of prison time. When you
drive recklessly, a death you cause is not an "accident" as you so
eupemistically state. Stop coddling these killers on our highways.

Kennedy to Search Iraqi Rivers for WMD

(2003-01-21) -- Senator Edward "Ted" Kennedy, D-MA, offered to help the U.N. weapons inspectors by personally searching the bottoms of the Tigris and Euphrates rivers for canisters of gas or biological agents.

The Senator, who had some experience diving on a submerged metal object in 1969, said, "Each citizen must do what he can to support the effort to disarm Saddam. I'm going to see if I can get to the bottom of this thing...as it were. I'm hoping to come up with something...uh...again, as it were."

Sen. Kennedy declined to discuss the specifics of his previous diving experience.

I'll answer the question for them. Janklow and Kennedy hold (or have
held) elected office with legislative or executive authority to make the
laws that the rest of us have to obey. Laura Bush does not.
