Driver from fatal crash freed

STILLWATER -- A Cushing man who was drunk driving when he had a
single-car traffic accident that killed a relative was released from
prison Thursday on the order of a judge who modified his sentence to
14 years of probation and a $10,000 fine.
Payne County Associate District Judge Robert Murphy Jr. noted Thursday
that the victim's family supported changing the penalty for Gary Allen
Schaffner Jr., 31, who spent 364 days in prison.
"This defendant had the benefit of more or less shock incarceration,"
defense attorney Royce Hobbs told the judge and noted that Schaffner
had "an excellent report" from the state Department of Corrections.
Hobbs said Schaffner's 13-year-old son needed his father.
A year ago, Schaffner's relatives tearfully testified about his
remorse and asked for leniency when Murphy gave Schaffner a four-year
prison term, to be followed by 11 years of probation.
Schaffner had pleaded guilty to first-degree manslaughter and leaving
the scene of the Jan. 28, 2003, accident that killed his passenger and
cousin, Jackie Lomboy, 17, a Cushing High School student. He also
admitted driving under suspension and having an expired tag.
In modifying Schaffner's sentence Thursday, Murphy ordered him to
complete his G.E.D., attend Alcoholics Anonymous meetings at least
twice per week, make arrangements to begin paying a $10,000 fine, and
not drive or attempt to gain a driver's license. Prosecutor Tom Lee
asked Murphy to leave intact the original sentence for Schaffner, who
told the judge Thursday he would return to his job earning $35 per
hour as a roughneck on drilling rigs for a company based in Oklahoma
City.
Lee originally urged a 15-year prison term followed by 15 years of
probation for Schaffner, whose blood-alcohol level was 0.12 percent,
which is higher than the legal limit of 0.08.
At his sentencing hearing a year ago, Schaffner said that he had had
four to eight beers before he ran a stop sign in Cushing and lost
control of his 1994 Mitsubishi Eclipse, which rolled several times and
landed on its top.
He said Lomboy was thrown into the road but was alive when he dragged
her onto the grass. He said a nurse, who stopped at the accident
scene, was with her when he left "to get more help." He surrendered at
the Cushing police station about 90 minutes later.
Lomboy was taken to Cushing Regional Hospital before being transferred
to a Tulsa hospital, where she died the next day.

You explain all judicial action you don't agree with as due to bribe
taking.
With not a shred of proof.
That's " libel per se." Normally, were you to be sued, the plaitiff
would have to prove malice on your part, a difficult thing to prove.
But in cases of charges about criminal behavior, and certain other
things, malice need not be proven.
Personally, I would not charge any lawyer, or judge, with breaking the
law, with absolutely no proof, as you do, because it would be
trivially easy for them to sue you and bankrupt you.
On the other hand, these matters are of political concern, so maybe
you are protected by the first amendment, which I guess would cut the
other way, and probably require proof that you actually know you are
saying things which are false, or which involve a reckless disregard
for the truth on your part. Isn't that the standard?
Anyway, it's sort of creepy, what you do, smearing people that way.
They just see things differently from you, pal. It's really that
simple.

Of course. Since Loco Laura's welfare check won't let it afford a nice
vehicle, it thinks that the rest of us should be denied also. And since
its POS "beater," can't keep up with the rest of us, well, there is the
prison crap that it keeps spewing forth across these newsgroups.
BTW, which NG are you a regular of and replying from (so in future
replies I can prune the newsgroups headers of Loco Laura's ECP
accordingly)?
