Drink-driver who killed his cousin walks free

A SUPERMARKET owner, who caused the death of his cousin in a car crash
while four times over the legal alcohol limit, has been given a
suspended two-year jail term because his actions were "out of
character".

District Court Judge Geoffrey Muecke yesterday said "it was unlikely
everyone in the community" would agree with the sentence to Blair
Athol man Phuc Huu Lam.

The 25-year-old had admitted the excessive blood alcohol level - .187
- and that he was speeding when he crashed into a guard rail and brick
wall at Medindie last year, killing his friend and cousin, Phong Duc
Tram.

Judge Muecke said causing death by dangerous driving was a "unique
offence" because, in cases such as Lam's, it involved "otherwise
hard-working, caring and good people".

"I have no doubt that despite your gross intoxication and excessive
speed, you were a person who fell within this category," he said.

He said he was not aware of any statistics which showed severe jail
sentences had an impact on the road toll. "It seems that alcohol and
motor vehicles are considered to be such important parts of our
society (and people) frequently continue to use both together," he
said.

He suspended the sentence upon Lam entering into a two-year
good-behaviour bond and banned him from driving for six years.
