Need help (urgent)!

I got 2 tickets for speeding and for improper passing. My court date is
on Tuesday. However the judge still didn't receive my tickets from the
police officer and told me to call back on Thursday (after the date on
the ticket). What I'm wondering about now is what will happen if I show
up in court on Tuesday, is there any chance of getting the ticket
dismissed if they didn't get it yet?

The court is required to send you written notification if the trial date
has changed.  If you have not received anything in writing, then go to
court on the day and time specified on your ticket.

If they don't call your case while you're waiting, then you can go to
the court clerk and see when your case is actually scheduled.

The judge himself told me to call on a day that's after the court date.
I asked him a couple of times if he realizes that and he said yes.
Since the court is actually > 2 hours away from where I live I
obviously have no intention of randomly showing up unless I have a
chance of having the case dismissed. So what I'm asking is whether or
not there is a chance of that happening??

The judge also knows if it's not in writing and not in court it doesn't
count. The judge can forget about the phone call. You need to show up to
protect yourself.

Why is noone addressing my question and instead answering something
that I didn't even ask..?:-\ I have less than 24 hours left for a
decision and still no answer.:(

1)  there's only one lawyer who posts here occasionally, and he hasn't
answered you.
2)  he will probably tell you to ask a lawyer in your neck of the woods.
3)  even if he did answer, anything he said would not be reliable, due to
the fact he practices in WI, and further, he doesn't know the judge and
county where this case is.
4)  because most of the people here don't care enough

get a lawyer involved NOW

Thanks. The case is in IN and I'm actually having trouble finding a
lawyer - all the ones I found specialize in DUI offenses and more
serious stuff. So I'm not sure how one goes about finding a lawyer for
speeding??

I cannot answer your main question. But hey, blow off the court date and
the judge forgets about the phone call and then you get pulled over and
arrested on a bench warrant, don't say I didn't warn you.

Please don't whine when you are asking for free advice.

Furthermore, free advice is worth every penny you paid.  At that price,
here's mine:  There is no record of the phone call.  If you don't show
up for the original court time, anything can happen, and you will have
no idea what it is.  You will have no say, and no knowledge.  If you go
to court you might waste a couple hours.  If you don't go, you might
not sleep for several nights.

It's not convenient, but it's not the least convenient thing that will
ever happen to you.

Hey, consider this.  If you were to demand a jury trial, you'd severly
inconvenience a bunch of other people too.  And you'd also expect them
to be fair!

Unfortunately, you're going to have to show up.  If you don't, and your
case is called, then there's a strong possibility of the court issuing a
bench warrant for your arrest for failure to appear (as you promised
when signing the citation that the officer issued).

There is a very good chance of getting the case dismissed if you do show
up, but the officer who issued the tickets isn't there (assuming your
case is called).

If you have a court date you have to show up, regardless of what evidence is
there.  If it's not there, then maybe the judge will dismiss, or extend, or
whatever.

My son had a time (he's in the Marines now!) when he was into cars which
would get him an automatic pull-over.  He had a number of fix-it-or-else
tickets and a couple for speeding (not serious ones.)  Anyway he discovered
that he could (he was making money) have a lawyer, who specialized in this
area, on retainer, and the lawyer would go to court for him.  The lawyer
always got the case resolved.

The judge told me not to... My question is if I actually do show up
what will he do if he doesn't have the tickets.

Depends.  you *should* probably move for dismissal, whether or not
it'll work... I dunno.

A decent chunk, but a clean driving record is worth a decent chunk too.

In any case, I would show up for the scheduled court date, because if
the judge conveniently forgets his phone conversation with you, you'll
be in a world of hurt, i.e. there may be a warrant out for you for
failure to appear if the ticket shows up and you aren't there.

Appear in court on the day specified on the citation (a little late to
be useful now).  If your case is not on the docket ask the Clerk for a
copy of the docket and proceed about your business.

Arif provided you the correct advice in the first reply within 20
minutes.  It's your responsibility to decide which is the correct
advice and which isn't.
