Bullshit. I was dragged "downtown" once by an over-zealous cop on a
Saturday night because he thought I was DUI.
The officer who administered the breathalyzer told me that the "DUI"
test was two pronged. They had the device for measuring BAC, and they
also observed the subject to make personal "observations." He told me
that my speech was extremely coherent, and that he felt like I would
have no problem with the breathalyzer. I didn't think I would, either,
but it wasn't my decision to be there. I ended up blowing a ".02", and
the administrating officer told me that the device sometimes
registered that "high" even if you hadn't had a drink in days.
The administrating officer also told me that the police officer who
pulled me in was a rooking gunning for a state record in DUI arrests
set the prior year by another officer in the county, who incidently
was a friend of mine. As such, the rooking was dragging everyone in
off the street that he could, and it was pissing the administrating
officer off because he was testing people that had no business being
there. :-)
The upside of it is this was a small county, and a lot of folks drink
in that county. With the "arresting" officer off the roads
baby-sitting a sober "dui", all the drunks didn't have to worry about
getting pulled. :-)
