Question.
In Texas, can you be drinking in your parked, car on the passenger side,
with the keys in the glove-box and not get a DUI?

I know y'all probably site me for PI but not a DUI?

Many thanks

Correct, since you have to be driving to get a DWI in Texas, have witness
statements putting you behind the wheel, or some other affirmative link to
the operation of a vehicle while intoxicated.

It all depends on the circumstances.

I take it there is no "open container," law in TX?

Yep.  We have that too, but it doesn't apply to the poster's original
questions.  It is an enhancement to the offense of DWI and/or citable on
it's own.

Nope - you're DUI if you're drinking in your car, keys or no keys,
engine or no engine.

It used to be reasonable there - you could actually DRINk while you were
driving as long as you weren't drunk.

Now MADD has taken over.

420 - approximate number of times I drove past MADD headquarters while
legally drunk.
