San Rafael Chevrolet wrecked my new vette and won't replace it or pay

I brought it in for two small warranty items, a jammed trunk, and a bad
antenna, on 12/19/06. and told them not to drive it off the lot, and
the next morning, Gene B, an employee, took it on a ride and wrecked
it, causing about $15,000 in damages to the front passenger side. The
chp report #marin chp 9350, officer Pozzi, lists the driver as driving
too fast for the conditions which caused the accident. An accident is
something that's unavoidable. This was pure careless acceleration out
of a turn, trying to pass on the right shoulder, into the gravel, and
he spun out donut style, and got run down by some poor box truck, which
was also damaged due to this guy's careless negligent driving. Now I'm
going down to make my $829 monthly payment, and my new vette, is
sitting in the body shop, wrecked. The dealer is refusing to replace
the car or compensate me for the lost value on resale. It took two days
to get a claim # and a rental. I found some drugs under the seat in an
orange prescription bottle, codeine acetominaphane, and some other
pills. My wife is heart broken. It has ruined our christmas. A lawyer
will cost us $5,000. I have more pics but don't know how to post them.
The dealer says his driver was not cited for reckless driving, but the
police never do that unless they witness it, and even then, it takes
100mph in a 25mph zone for them to cite. It might help us for people to
let the dealer know they bad publicity will prevent them from buying
from that dealer. It will take 6 weeks for the car to be repaired, and
we will not be driving it even after it is repaired due to the filthy
nature of the drugs and the accident. This has ruined the car for us.

that sucks, but I didn't know Corvettes had trunk lids. Did this
change for the C6?

C5 convertibles and Z06's have always had trunk lids. The same is true
for C6's.

Hmm... Sounds like the dealer stepped up to the plate and did the
right thing.
If I'm ever in the Beige Area and my 'Vette needs service, I'll be
sure to look them up.

I suspect the dealer knows what would happen if he didn't come through.
A lawsuit would get deep into his pockets. It happened up here in
Spokane many years ago with one of the muscle cars. Picked it up and
the mileage was -way- out of line plus tranny doing weird things.. The
dealer denied anything had happened but the owner had proof on the
mileage. Ran it right down to the almost the day before court before
the dealer made him good.
Damages in a lawsuit get real bad, real fast.

Nobody wins in a lawsuit, except the lawyers, who always win.
The only guy who threatens to sue is the guy who has never been
involved in a lawsuit, or an idiot. Suits suck from both ends, souls
and money.
