Driver gets murder charge

• East Dundee crash: Grand jury indicts Elgin man in death of 16-year-old
student

An Elgin man who authorities said was drunk last month when he slammed
his car into the Haeger Potteries building in East Dundee, killing a 16-
year-old passenger, has been indicted on a first-degree murder charge in
connection with the crash.

The indictment was returned this week by a Kane County grand jury against
Brian Poliarny, 18, of 1015 Biltmore Drive, the state's attorney's office
announced Wednesday.

Poliarny -- whose initial traffic charges included failure to reduce
speed to avoid a collision -- is charged with one count of first-degree
murder, four counts of aggravated DUI, one DUI count and one count of
driving with a suspended driver's license.

According to police, Poliarny was driving a 1994 Mazda northbound on
Elgin Avenue about 4:20 a.m. Jan. 12 when the car continued through the
T-intersection at Williams Place without stopping, then crashed into the
south wall of the Haeger building.

The impact killed 16-year-old Dundee-Crown High School student Roman P.
Pokorny of Carpentersville, who was in the front passenger seat and was
not wearing his seat belt at the time of the crash. Poliarny and backseat
passenger Toni Szymanowski, 18, of East Dundee, were both seriously
injured in the crash, police said.

Whiskey Tango Foxtrot?  No under-21 alcohol charge?

The weasel needs to be nailed at least for driving with the suspended
license.  He would have been a crook even if sober.

I don't want to rain on anyone's parade, but even if a jury finds him guilty
on murder in the first (which isn't likely, there will probably be a plea
bargain, and the defendant will probably pleadf guilty to a lesser charge),
if he hasn't had any prior arrests or convictions, the judge most likely
give him a slap on the wrist, maybe a couple of hundred hours of community
service, and probation.
