Police: Driver's Alcohol Level Was .491
Man To Appear In Court Friday

PROVIDENCE, R.I. -- Rhode Island state police said they arrested a man
whose blood alcohol level was .491, more than six times the legal limit.

They believe it's the highest level ever recorded in Rhode Island for
someone who wasn't dead.

The man was arrested early Tuesday morning after he drove his car into a
highway message board on Interstate 95 in Providence. Troopers had to carry
him to the breakdown lane before taking him back to their barracks.

A trooper said a Breathalyzer test registered blood alcohol readings of
.489 followed by .491.

The man was released from custody after promising to appear at a court
hearing Friday.

I know it is hopeless to point out reality to you but I will anyhow.

I don't know what the procedure is in that area but the AMA, and some
states laws (WA for one) ban incarceration of anyone with a BAC of .25
or higher due to the danger of death from alcoholic poisoning.
Standard here is .25 or higher - to the detox ward.

The other standard here and most other places is to release anyone
arrested for DUI that can be released to a responsisble party.

The releases have nothing to do with avoiding charges.  They are given
a court date.

I suppose in your stupidity you can't grasp the idea of not putting in
jail someone who has not been convicted of a crime unless it is needed
for public safety?

There I wasted time and electrons answering someone so stupid it has a
helper that constantly reminds it to breath.

He's not defending drunk drivers. He's advising you that it is
standard practice to release DUI's after being given a court date.
That is basically the same as being released after signing the ticket
you got for speeding.  If he fails to appear in court, then he will be
arrested and placed in jail.

Haven't you ever seen "Cops"? Many times they will release a DUI to a
sober person instead of arresting and putting him in jail. Do you know
how much paperwork and time and money that act saves?

Do you know how stupid _you_ are?  I ran a jial for 15 years so, yes,
I do know WTF I am talking about.  standard practice is to release
prisoners if at all possible vice booking them.  Book only for public
safety or to ensure they will be there for court.  In addition to

Drunk driving is a matter of public safety, you idiot.  People are killed
by drunk drivers every day!!!

And if bond is set at say $50,000, they will not be on the road in an hour.

I know, but that needs to change.  DUI is a super-violent crime and it
should be treated as such.  Lock them up and hit them with bail of S100,000

That's called criminal coddling. Drunk driving is the biggest crime problem
we have.
