David M - 26 May 2007 13:38 GMT On Fri, 25 May 2007 23:59:26 -0700, dupedcyclist spouted some idiotic babble:
"Nobody else was injured when Hancock, 29, rammed a rented SUV into the back of the tow truck in the left lane of westbound Highway 40 near the Compton Avenue overpass shortly before 1 a.m. April 29.
Police said their investigation showed he was not only drunk but driving 68 mph in a 55 mph zone and talking on a cell phone when he died. They said the wrecker's warning lights were flashing. Hancock was alone in his vehicle."

The Ford Explorer did not "cause" the death. His choosing to drink alcohol did.

Jeff Strickland - 26 May 2007 16:58 GMT Who woulda thunk it?
A guy sits down at a bar, fills himself full of booze then kills himself, and he has no responsibility for his decisions. Amazing.
I think we have it all wrong.
I think that when a guy sits down at a bar and fills himself full of booze, then gets in a car and starts driving, and kills somebody, then his family should be held responsible.
Whitelightning - 26 May 2007 18:53 GMT > Who woulda thunk it? > [quoted text clipped - 6 lines] > booze, then gets in a car and starts driving, and kills somebody, then his > family should be held responsible. Daddy is just looking to line his pockets now that he has lost his cash cow. I always figured if someone guy or gal, it nows no boundries when it comes to sex, kils someone because they drove drunk ior high for that matter, they should be charged with premeditated murder. I figure they knew what could happen if they drink and drive and choose to anyways, in my mind that makes it premeditated. When I was stationed in Germany their laws made sense to me. A German, or a servicemans family member gets caught drunk behind the wheel it was 6 months in jail, and no license for 24 months. Had to go back to a driving school, substance abuse classes, major expensive insurance to get license back. A second bust was 18 months in the slammer and permanent loss of license. A serviceman didnt fall under that by some sort of agreement between the governments, but it might have been easier. It meant reduction in rank, being sent back to the states, court martial, and dishonerable discharge after some time as a "guest" of Ft Lebenworth. If the rank reduction dropped the soldier below E-4 it could mean the loss of everything he owned, as below that rank you cant get the military to ship household goods back, so a married soldier and his family could loose everything.
We are too lienent on drunks and druggies who get behind the wheel impaired.

SnoMan - 27 May 2007 13:59 GMT >> Who woulda thunk it? >> [quoted text clipped - 30 lines] > >Whitelightning I was surprized that thye even filed this suit and it is the first time i can every remeber such a suit. It is kinda like it is okay to drive drunk and people are soppose to stay out of your way so you can drive drunk and speed too. Maybe he is trying to prempt a law suit against estate because son caused the accident. I do also agree that drunk driving laws are way to lack here and you should get at least 3 day in the tank for it first time and after 3rd time you should do some very hard time in jail. They are also too lack on people driving with a suspended license be it for drunk driving or something else. They should do time in can over that and same with no insurance if they get caught. Politically it is not very viable so they do not do it. ----------------- TheSnoMan.com
Jeff Strickland - 27 May 2007 16:57 GMT >>> Who woulda thunk it? >>> [quoted text clipped - 53 lines] > they get caught. Politically it is not very viable so they do not do > it. There was a suit filed against GM a few years ago where a drunk was driving, and he caused a crash. He brought a suit against GM because a door on his vehicle came open as a result of the wreck, and he fell out. He was not wearing his seat belt.
If he was suing from behind bars, serving 20 to life for Felony Stupid, and the government seized his award to pay the costs of his incarceration, I'd be okay with that.

Did GM hold him down, pour the alcohol down his throat and then hold a gun to his head to get him to drive as well as not use his seat belt?

What I meant was that if the guy won such a suit (and as I recall, he did win), then he should have made his claim from behind bars, and he should have been held financially responsible for the cost of his incarceration.
