I hope someone can help. I have a K-reg mini city which someone drove into
the side of last week. The guy gave me his number and car reg but said he
didn't want to involve his insurance company (probably doesn't have it) He
said he didn't see me cos my car was 'too small'.
The damage is just to the passenger door- a big dent the size of a volvo.
He said he'd pay for it to be fixed so I've got a quote from my local repair
man who said he could do new 'skin' and spray for about ?300 or get me a
door from a scrap yard and spray it for about ?200 (including the door).
Now this bloke says its extortionate and won't pay more than ?150. he said
'it's only a mini'
Is there anyone out there who can advise me whether or not this is a good
price or where to go to from here? I could threaten the guy with the police
but what will happen then? Ultimately I just want my poor little mini fixed.

i would get the cops involved. my opinion anyway. he prob dont have
insurance that's why. I know i would if my snoopy gets touched :o)

Are you prepared to get your insurance company involved, if you are contact
them, get them to contact the bloke who hit you, claim against him, he has
already admitted responsibility.

I agree with other posts, being too small, what a load of bulls**t, what if
it was a mother pushing a pram, he would prob have said I killed the baby
because your pram was too small, the first mistake you made was not to phone
the police, he wants to give you ?150, a whiplash claim alone these days is
worth ?2000, seriously, everyone does it, its always worth getting as many
witnesses as poss to, go to the police now & tell them you where unsure of
the rules at the time & the Volvo drive gave you his name & address then
left refusing to wait for them, you did not phone the police because you
where in shock, even a week later its still not to late to go & see a doctor
with the severe pain you have in your neck & shoulder, don't say "well
threes nothing wrong with me & it would be dishonest", its part & parcell of
thing these days, someone else would do it to you, get even, bad drivers
need taking to the cleaners,

This is one of the most disgusting things I have heard in ages.
The UK used to be a fairly decent place, but the whole civil-legal system
the US employs seems to be seeping into the grain of the population. And
with it, the UK is losing its fabric as a country known for being filled
with justice-minded and fair people. I lived in the US for a while, but
would never go back, for that reason: People pitching lawsuit east and west.
Please, dude, if you weren't hurt in the accident, don't fake it. It just
ain't worth the hassle, and you really don't want to go through that kind of
sh.t.

tell the Volvo driving prick there is know such thing "as only a Mini"!!!!!
ask him how many cherished old Volvo's do you seeing being driven....and
then tell him you are taking it to your insurance company and let him deal
with them !

I made the mistake of letting a BMW (!!!) driver off when he was the cause
of an accident I had. I was driving toward BMW GB at the time funny enough
on my way to work, i was approching a nasty right hand hair pin bend on a
country road, this bend had a junction on it on the left, as i was slowing
down to take the right hand bend the BMW pulled out right in front of me,
the mini's brakes werent brilliant and because it was damp were not up to
it, they locked and the car ended clipping the back of the BMW and finished
up in a ditch. The BMW shot off, I got out with a sore arm as i was wearing
static belts.
People stopped and helped push the Mini out of the ditch, the car only had a
minor ding on the wing and a slightly dented wheel rim. Minutes later, the
BMW driver, knowing he had done wrong came back as I was getting back in the
Mini, I told him to EF off and didnt want him anywhere near me, in hindsight
I should of thrown the book at him, after all, I had plenty of witnesses
that saw what happened and him return to the scene ackwoledging his error.

handle the claim.

for the cost of restoring it to it's previous condition.

Do you have insurance?
If not then you'll have to go through the whole rigmarole of a letter of
demand, and possibly eventually lawyers.

Nothing. The police won't be interested. It's a civil matter not a
criminal matter.

And he knows you're young and easily pushed around.
What I would do at this stage is either hand it all over to your
insurance company to sort out, or have a lawyer write a "letter of
demand" and send it to him. Strike early with a lawyer's letter and he
will take you seriously.

As I understand it, not giving your details and having a dispute over
who pays what for accident damage is indeed a civil matter.
However, driving without insurance is a criminal offence and the
police are obliged to investigate if it is suspected that a driver is
not insured.
I have some knowledge of this, having been a special constable for the
last 10 years.
The police here in the UK thoroughly enjoy victimising motorists by
issuing fixed penalty speeding tickets and we love that chap from
Holland who invented the Gatso camera. It gives us a good excuse not
to be out catching real criminals:-)

In the context of Alan's comments, that the guy almost certainly does
have insurance, this makes sense. In Australia, being "difficult" about
a claim is typically an indication that you're dealing with an uninsured
driver and if they don;t want to pay up then you will most likely have
to take them to court.

There aren't many Gatsos around this neck of the woods that remain fully
operational for very long.

Also get the repairs done at the best body shop you can find. Ask your
local Mini Club to point you in the right direction and get it done properly
and don't use any insurance recommended repairers as they don't do a good
job, yes they may give you a courtesy car and save you the hassle of taking
the car there and fetching it back but the finished work won't be good trust
me.

I used to deliver parts to Direct Line Insurance Body works in Middlesex,
from what we used to sell to them and repeatedly aswell, I would say that
most national repairers are awful! Stick to recommendations from friends and
people in the know.

Ahhh, this is key information which is different in Australia. We're
still a third world country where you are allowed to drive a car with no
third party property insurance.

Third party personal insurance (injuries to others) is compulsory here
and driving without it is viewed very seriously.

Even though the accident is not your fault, the correct procedure is
to inform your own insurance company that you have had an accident and
that you hold a third party responsible, they will send you a claim
form to fill in and will pursue the other driver for payment, either
personally or through his/her own insurers.
This is a service that you pay for when you buy your insurance.
A lot of companies such as Churchill and Tesco , Egg insure etc will
arrange for your car to be fixed at an approved body repair centre
before they have recovered payment from the third party and will not
charge you a penny.
You will not lose your no claims by doing this.
Give your own insurers a call. Don't think you are obliged to sort
this out privately, the other guy is not your problem.
Of course you could inform him that you will be doing this as you are
dissatisfied with his attitude, remind him that he probably has an
excess of £150 or so on his insurance policy (if he has one) and that
£300 now for a quick end to the matter will cost him a lot less than
£150 excess plus reduced no claims bonus for the next 3 years.
The Police are a last resort, but this too can be handled by your
insurance company.
