Nissan Warranty

I have an Almera, 6 months from new, first gear keeps dropping back to
netural.On Thursday am I am taking it to Dixonmotors where it was
bought. I am told if it is necessary to remove the gear box, Nissan
will not authorise it. I must authorise it, ( work will still be done
under the warranty).
(I have tried to contact Nissan by email but they have not
replied.Telephone calls are a 'pillar to post job'
It there a logical explanation or am I signing away some rights I now
have.?

Hi Peter,
From past experience with V.W. dealership, it may be advisable to speak to
your C.A.B. or Local Trading Standards Dept.
You do not state if Dixonmotors is a Nissan dealer, however, any garage
that sells a car under their or Nissan warranty, should honour the
warranty under the heading "The product should be fit for the purpose it
was made" or words to that effect. If the car was new, then the warranty
should last for 3 years minimum and whoever sorts the problem out, the
gearbox should be covered for this same period after repairs.
Send a registered letter to Nissan about the fault (keep a copy) and give
them seven working days to reply by letter. They may wish to phone you
(give them your number) OR get Dixonmotors to chase them up, after all, it
is they who will be reclaiming the costs from them!
If all else fails, ask for your money back in full OR ask for another new
car.
The Financial Ombudsman is very helpfull if you have hastle. (Let the
garage know that you are reproting the problem as they don't like
hastle!)
V.W. stated that there was no problem with my gearbox, I took them to
court and had a Gearbox Specialist report that damage was internal and
seizure was imminent. I lost my claim because I had no signature on the
report. However, the judge ordered that they relook at the gearbox, and
within 10 mins. V.W. stated that it had to be stripped and repaired. This
took over 12 months.

Thank you Dave for this very informative information. Dixon Motors are
Nissan agents. Car taken in to day, they now need it a further day.
Awaiting results.

Car in garage for 2 days. Upon collection told gear box had been
removed and 1st gear bearing plus another part had been replaced.
All well , but a few days on, upon changing gear and driving a short
distance a stange noise from gearbox. Hope this is not further problems
in a new car.

Any loud noise that is blatently not normal for your car model *could*
result in early-expired components in the future.

Get it back to that garage pronto! Nissan are rated very highly by the car
industry generally, but of course do have their crap models like any other
car manufacturer. If it aint sounding right it probably isn't :-)

Glad to hear that Nissan are co-operating to some extent with this 'major'
problem. I think it is time that you should be pushing them for another
NEW gearbox. Anything that is stripped down for investigation or repairs
comes under the heading 'It was NOT FIT for the purpose it was intended
from new'. Be polite and patient but insist on this and ensure that you
are given another car when this is done. You should not be at a loss for a
Nissan fault as you bought it under warranty.
Secondly, Nissan may insist that you insure a loan car on YOUR insurance
policy after their TWO day loan max. period. Don't accept this, as any
damages will be on your insurance. Ensure you inform your Insurers about
any such differences if you have no alternative.
If Nissan do their schedualing correctly, they should have the new gearbox
in stock and fitters available BEFORE you give them your car and this
should be ready for you within hours.
Finally, any strange noises from gearbox or other parts that Nissan could
have touched should be reported back to them IMMEDIATELY.

Thank you mistyds, an excellant reply and very sound advice. Just about
to take up the issue with Nissan when the problem  noise suddenly
disappeared.(Someting must have settled down)  The gear box is smooth
and no stange noise is apparent.. One just hopes that this continues.
